Biocon Settles Patent Dispute With Genentech; Shares Down

Biocon Ltd
The agreement resolves pending patent disputes between the two companies across the US, Canada.

Shares of Biocon Limited were trading in the red and 1% lower on 14 October after the company announced that it has entered into a global settlement and licence agreement with Genentech, securing launch dates for Pebrilzo, its biosimilar version of the cancer drug Perjeta.

The agreement resolves pending patent disputes between the two companies across the US, Canada and other jurisdictions, giving Biocon a clearer path to introduce the treatment in key international markets.

Under the agreement, Biocon can launch Pebrilzo in the European Union and the UK in the first quarter of calendar year 2027. The US launch is scheduled for the third quarter of calendar year 2028. In other global markets, the company can launch the product during 2026 to 2028, with the possibility of earlier launches in certain circumstances.

The agreement settles all pending disputes between Biocon and Genentech, including proceedings in the US, Canada and other jurisdictions. The companies have not disclosed the financial and other commercial terms of the settlement. The launch dates also remain subject to applicable regulatory approvals.

Pebrilzo contains pertuzumab, a monoclonal antibody used to treat HER2-positive breast cancer across multiple stages of the disease. It works by targeting the HER2 protein, which can promote the growth of certain cancer cells.

The drug is a biosimilar to Perjeta, a reference medicine developed by Genentech. Biosimilars are highly similar versions of existing biological medicines and can help expand treatment options once regulatory and market-entry requirements are met.

The settlement is significant for Biocon as it removes a major legal hurdle to commercialising the product in several markets. The company has also been advancing its pertuzumab programme, with its product receiving a positive recommendation from the European Medicines Agency’s Committee for Medicinal Products for Human Use in September 2026.

The agreement gives Biocon greater clarity on the potential commercial rollout of Pebrilzo, with Europe and the UK offering the earliest major-market opportunity. The US launch window is later, leaving more time before the product can contribute to sales there.

At 11:35 am, the shares of Biocon were trading 0.27% lower at Rs 350  on NSE.
