On Monday, the Supreme Court ruled that Adani Ports and Special Economic Zone’s (ADP) exclusion from the Visakhapatnam Port Trust (VPT) cannot be used as justification for the company’s exclusion from future contracts. Adani Ports has been requested by the supreme court to withdraw its petition, and the request has been accepted by the business.
Adani Ports filed a complaint with the Bombay High Court in June, accusing the Jawaharlal Nehru Port Authority (JNPA) Board of Trustees of unfairly rejecting its proposal to modernise a container terminal in Navi Mumbai.

Adani Vizag Coal Terminal Pvt Ltd (AVCTPL) and Vishakapatnam Port Trust are reportedly planning to sue one other, which led JNPT to effectively reject Adani Ports’ bid.

The company had attempted to rescind its disqualification from the tender and claim that it was wrongfully and illegally excluded from the competition.

Adani Ports, however, sued the Supreme Court to seek relief when the Bombay High Court did not rule in its favour.

In its suit, Adani Ports claimed that since 2011, Vishakhapatnam Port Trust and Adani Vizag, a company affiliated with Adani, had a contractual relationship. AVCTPL wanted to terminate the concession deal during the epidemic by citing the force majeure clause. However, Vizag Port refused, and Adani Vizag, therefore, cancelled the concession deal on October 21, 2020, with effect from January 19, 2021.

The disagreements and conflicts between AVCTPL and VPT were submitted to arbitration by AVCTPL on November 30, 2020. The writ suit claims that in response, VPT terminated the concession agreement with AVCTPL by sending a notification on December 26, 2020, with the termination taking effect after 90 days.
