The Delhi High Court has declined an urgent hearing on a Public Interest Litigation (PIL) seeking a ban on the Chinese AI model DeepSeek, advising the petitionerβs counsel to avoid using it if deemed harmful.
Advocate Bhavna Sharma filed a PIL in the Delhi High Court, arguing that the AI model DeepSeek violates Indiaβs Digital Personal Data Protection (DPDP) Act and IT Rules. The petition seeks a ban on the model across platforms in India and requested an urgent hearing, which the court declined.
The Union Finance Ministry has advised government employees against using AI models like DeepSeek and ChatGPT, citing concerns over document confidentiality.
Like many similar platforms, the Delhi HC noted that DeepSeek is available online and that those who find it harmful are not obliged to use it. The court saw no urgency in the matter and refused an early hearing.
Previously, the Delhi HC asked the Centre to clarify its stance on DeepSeek and any potential action.
In January, IT Minister Ashwini Vaishnaw stated that the government was working to bring DeepSeek to Indian servers, as the model currently stores data on Chinese servers. The open-source nature of DeepSeek allows India to replicate it on local servers.
