The NCLT Bar Association has urged the Ministry of Corporate Affairs (MCA) to urgently relocate the National Company Law Tribunal’s New Delhi office due to serious infrastructure failures disrupting judicial work.

On 3rd September, the Tribunal informed advocates and litigants that Courtrooms IV, V, and VI on the 8th floor would be closed. This was due to severe water seepage. The NCLT operates from the 6th to the 8th floors. As of 4th September, all courts began functioning on a half-day basis, using only the 6th and 7th floors.

The leakage has damaged the false ceiling, raising risks of collapse, electrical short-circuits, and fire hazards. The CPWD inspected the site and declared the courtrooms unsafe until repairs and certification are done.

The Bar Association, led by President and Senior Advocate UK Chaudhary, said the situation has nearly brought the NCLT’s functioning to a standstill. It has also undermined trust in the insolvency and company law framework.

They also pointed out that the office space is inadequate. There is no bar room for advocates, no photocopying facilities, and no functional canteen. Court No. VI had even been operating temporarily out of Court No. V.

Calling the closure of the 8th floor a complete obstruction of justice and a denial of citizens’ right to legal remedies under Article 39A of the Constitution, the Bar warned it would take all necessary steps. This action is contingent if authorities fail to act.
