Delhi HC Adjourns WhatsApp, Meta Appeal in CCI Case to July 21

The Delhi High Court has adjourned the appeal of Meta and WhatsApp against a Competition Commission of India (CCI) probe into the messaging app’s 2021 privacy policy to July 21. A bench of Justices Poonam Bamba and Rajesh Shakdher adjourned the matter after WhatsApp’s counsel. Senior advocate Harish Salve said that the Personal Data Protection Bill still needs to be passed.


In January 2021, the CCI had decided to look into WhatsApp’s privacy policy after allegations that it shares data between WhatsApp and Facebook, which breaches the Competition Act 2000. On March 24 last year, the CCI ordered its director-general to investigate the new privacy policy. WhatsApp and Meta challenged CCI’s order, but the Delhi High Court dismissed the plea. The data-sharing policy seemed suspicious and could potentially damage the competitive process and create barriers to market entry, the CCI had said in its order.
